Terms of Service
Version 1 · Effective date: 2026-10-16
1. About CargoProof CargoProof provides transport coordination, scoped information sharing and evidence-recording workflows, including documents, checkpoints and a Transport Passport. The service provider and operator is EU STARS LTD. EU STARS LTD. 22 Hristo Karaminkov Str. 5000 Veliko Tarnovo Bulgaria Company / VAT No.: BG208160628 office@eustars.eu 2. Scope and acceptance CargoProof is intended primarily for business and professional use. These Terms apply when you create or use a CargoProof account, accept an invitation or participate in a secure-access workflow where the Terms are presented, or otherwise use the service after being given reasonable access to these Terms. By doing so, you agree to the Terms applicable to that use. If you act for an organisation, you represent that you have authority to do so. Separately agreed order or commercial terms may supplement these Terms for the services they cover. 3. Eligibility and authority Use CargoProof only where you have the legal capacity and authority required for the action. If acting for a company or another person, you must have permission to do so. Do not misrepresent your identity, role or authority. CargoProof is intended for business/professional transport activities and is not marketed to children. Account creation is not proof of professional qualifications and does not itself grant company membership, Driver status or transport rights. 4. Account registration and security Provide accurate contact information and maintain control of your sign-in email and devices. Email links and one-time codes are authentication credentials: keep them private. Existing password sign-in is available where configured for an account. Google and Facebook sign-in are implemented but currently disabled; if later enabled, they are alternative methods of accessing the same CargoProof account, subject to safe identity checks. Keep account details current and notify the operator of suspected unauthorised use. 5. Guest and secure-link access A secure link or QR code may provide specified viewing or actions without registration. It does not by itself create permanent identity, company membership or general workspace rights. Access can expire, be revoked or become unavailable when its scope no longer applies. Share links only with intended recipients. Creating an account later does not retrospectively upgrade the assurance of earlier guest evidence. 6. Company and workspace relationships An account is separate from active company memberships, company roles, Driver links and transport participation. Access depends on the relevant relationship and permissions. You must not use another person's access or assume that seeing a menu grants authority. Company representatives are responsible for keeping their authorised users and shared information appropriate; this does not remove the operator's own statutory duties. 7. Permitted use Use available functions for lawful transport coordination, communication, document handling and evidence recording within your permissions. Review the transport and action context before confirming a statement, uploading content or sharing access. You are responsible for decisions and instructions you make through the service. 8. Prohibited use Do not submit unlawful content, knowingly falsify evidence, impersonate others, misuse location or personal data, infringe intellectual-property rights, distribute malicious files, circumvent access limits or disrupt the service. Do not use CargoProof to monitor people without an appropriate lawful basis and required information or permissions. Report suspected security issues responsibly. 9. Transport data and evidence CargoProof records information supplied by participants or generated in supported workflows. Source, time, authentication and verification context matter. Records may be reported, self-declared, authenticated or verified only within a specific workflow; the service does not guarantee that every submitted statement is true or independently checked. A status, badge or Transport Passport must be read with its scope and underlying sources. 10. Uploaded content and documents You must have the authority and lawful basis to upload, use and share documents, photos and personal information. Take reasonable care over accuracy and relevance, and do not include unnecessary sensitive data. You retain rights you hold in your content. You permit the operator to store, reproduce, process and display it only as needed to provide the service, support authorised sharing and meet applicable lawful obligations; this is not a transfer of ownership. If a record is disputed, request correction or restriction rather than assuming all history can be rewritten. 11. Location and signature evidence GPS data depends on the device, permission, reception and information supplied. CargoProof does not guarantee its availability, precision or proof of physical presence. A screen-captured signature is additional electronic evidence of an interaction with its associated statement and context. It does not automatically prove identity, authority or the truth of the statement. 12. Electronic records and signatures Screen signatures and recorded interactions are electronic evidence associated with a workflow. They are not automatically qualified electronic signatures (QES), trusted certificates or qualified trust services under eIDAS. CargoProof does not automatically make every document legally equivalent to an eCMR or a qualified signed document. Applicable legal requirements, the agreement between the parties and the actual workflow determine the significance of a record. Obtain appropriate advice where a regulated form or signature is required.
Service limits, responsibilities and contact
13. Service limits and third-party facts CargoProof is a transport workflow/evidence SaaS, not a carrier, freight forwarder, insurer, surveyor, customs authority, court, qualified trust service provider, certification authority or legal adviser. It does not independently certify all cargo, delivery, damage, identity or compliance facts. It helps organise and preserve information; it does not replace the professional, legal or transport obligations and decisions of participants. 14. Transport and commercial responsibility Transport arrangements, cargo handling, delivery, insurance, customs, payment obligations and claims remain governed by the parties' contracts and applicable law. CargoProof is not automatically a party to those arrangements because they are recorded in the service. An incident or claim record is not an acceptance of liability, insurance coverage or a binding resolution. 15. Availability and maintenance CargoProof does not promise uninterrupted or error-free availability. The service may be interrupted for maintenance, security, faults or events outside reasonable control. Access may depend on your device, internet connection, email, mapping, authentication or other infrastructure providers. A separately agreed service level applies only to the extent expressly agreed. Keep independent copies of documents you are legally required to retain. 16. Features, fees and orders Availability may depend on the service arrangement, permissions and enabled features. Some features or services may be paid. Applicable pricing, order, subscription or other commercial terms will be presented or agreed separately before charging and may supplement these Terms. These Terms do not establish a price, credit price, subscription duration, free-trial duration, refund period or authority for automatic recurring billing. Recurring billing is not represented as currently active. Mandatory consumer or other statutory rights, where applicable, remain unaffected. 17. Intellectual property CargoProof branding, software and service materials are protected by applicable rights. You may use the service as made available for its intended purpose; these Terms do not transfer ownership of the platform. Rights in user content remain as described in section 10. Do not remove attribution or misuse another party's protected materials. 18. Confidentiality and sharing Respect confidential transport, personal and commercial information that you receive. Share only with authorised recipients and use it for the relevant purpose. A recipient's ability to view or download does not authorise unrestricted onward disclosure. Access restrictions cannot prevent every misuse once information has been legitimately received. Any additional confidentiality agreement continues to apply according to its terms. 19. Privacy The Privacy Policy at https://cargoproof.net/privacy explains relevant personal-data processing. Companies and users retain their own responsibilities for information they submit and disclose. These Terms do not replace a required data-processing agreement or shift the operator's statutory controller/processor obligations to users. 20. Suspension and termination CargoProof may reasonably restrict or suspend access where necessary for security, fraud or abuse prevention, unlawful activity, material Terms violations, protection of users or the service, legal requirements, or material service/payment issues where separately applicable. Measures should be proportionate. Advance notice cannot be promised in every case; where lawful and practicable, the reason and an opportunity to resolve the issue may be provided. Ending a company membership or scoped link is distinct from closing a persistent account. Contact office@eustars.eu for account closure or review of a restriction. 21. Data after access ends Ending access or closing an account does not necessarily immediately destroy historical transport evidence, audit/provenance records, data needed for legal claims or security records. Historical online access, archival status and physical deletion are different. Retention depends on justified purposes, applicable law and processing arrangements. Where backups are maintained, residual copies may remain temporarily under normal protection and lifecycle controls; immediate deletion from every backup is not promised. There is no indefinite-access promise. Privacy requests are assessed under applicable law. 22. Disclaimers Evaluate information in its source and workflow context. CargoProof does not warrant that every submitted fact, generated record or third-party service is complete, accurate or legally sufficient for every purpose. This does not excuse the operator from obligations imposed by law or an express service agreement. No disclaimer excludes a guarantee or right that cannot lawfully be excluded. 23. Liability Each party’s responsibility is determined by applicable law and any valid service agreement. CargoProof does not guarantee third-party or user-supplied facts; GPS, network and provider availability may vary. Users remain responsible for their transport, commercial and legal decisions. Any exclusion or limitation applies only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. These Terms introduce no monetary liability cap or indemnity. 24. Governing law and disputes These Terms are governed by the laws of the Republic of Bulgaria, without prejudice to any mandatory rights that may apply under applicable law. Disputes shall be subject to the jurisdiction of the competent Bulgarian courts, unless mandatory applicable law provides otherwise. This provision does not deprive consumers of protections or access to another court available under mandatory law. For questions and disputes, contact office@eustars.eu. 25. Changes to the service and Terms The operator may update features and these Terms. Material contractual changes require appropriate notice and any acceptance required by law or the applicable agreement. Changes are not automatically retrospective and do not authorise incompatible data uses. The published Terms must identify their effective date and version. 26. Language and other agreements English and Bulgarian versions are intended to have equivalent meaning; these Terms do not establish automatic priority for either language. Separately agreed written order or commercial terms may supplement these Terms for the services they address, subject to mandatory applicable law. Contact office@eustars.eu if clarification of an apparent discrepancy is needed. 27. Contact For service, contract or account-closure questions, contact: EU STARS LTD. 22 Hristo Karaminkov Str. 5000 Veliko Tarnovo Bulgaria Company / VAT No.: BG208160628 office@eustars.eu
